Privacy Policy

We are committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

All data collected are safely stored by:

 Tutor Cafes 

(1) What kind of personal information do we collect and store?

In reference to customers:

a)     We might collect and sight our clients (this is a student’s) academic grades and evaluations. By signing this document, the client/parent/guardian gives us permission to do so. Those information will be passed on to those of our (sub)contracted teachers/educators who will deliver an educational program/a tutorial session/ home-schooling support to the client/parent/guardian. The (sub)contracted teacher/ educator is not allowed to pass those information or information obtained by him to any third party, except us. The storage of such information does not occur, unless a separate permission is given by a client/parent/guardian.

b)     We collect and store the following data of our customers (clients/parents/guardians): Full-name, home address, address where the educational program shall be delivered, home phone number, mobile phone number, email address, signatures of the client/parent/guardian in the lessons diaries as well as in a contract (which prove that (single) tutorial and/or educational sessions took place), and details that are required to successfully instigate payments between the two parties (Us and the customer). The latter information can be (e.g.) banking or credit card details. The details that refer to payments depend on the payment agreements that are otherwise in place between the two parties (Us and the customer). By signing this document the client/parent/guardian gives us permission to hand the listed data, except the data that are relevant to instigate payments between us and the customer (client/parent/guardian), to those of our (sub)contractors who will deliver an educational program/ tutorial session/ home-schooling support to the client/parent/guardian.      

In reference to subcontractors:

a)     We sight, collect, and store (copies) of documents that refer to a contractors academic achievements, evaluations, and certification as well as other documents that refer to professional skills and experience, relevant for being a professional educator. We furthermore sight, collect, and store documents referring to a contractors registrations with one or more Australian state’s teacher boards and/or other academic boards and (governmental) accrediting agencies and bodies, and documentation that displays the contractors permission to work with vulnerable people (what includes a police background check). Further, we will request, sight, collect, and store regular up-dates on the previously mentioned professional credentials of the contractor, in particular the governmental permission to work with vulnerable people.  By signing this document, the contractor gives us permission to do so. The mentioned information can be passed on to our clients/parents/guardians for which the contractor performs and implements and educational program and/or tutorials. The client/parent/guardian is not allowed to pass the mentioned information to any third party.  

b)     We collect and store the following data of our contractors (i.e. teachers and other qualified staff who deliver our educational programs to clients/parents/guardians): Full-name, home address, address where the educational program shall be delivered, home phone number, mobile phone number, email address, signatures of the contactor in the lessons diary and contract (which prove that (single) tutorial and/or educational sessions took place), other signed documents, and details that are required to successfully instigate payments between the parties (the contractor and us). This can be banking or credit card details. The exact details that refer to payments depend on the payment agreements that are otherwise in place between the two parties. By signing this document the contractor gives us permission to hand the listed data, except the data that are relevant to instigate payments between us and the contractor, to those of our clients/parents/guardians to which the contractor delivers an educational program or a tutorial session.     

 

(2) How we collect personal information and where it is stored

Wherever practically possible, the data that are sighted, collected, and stored remain on hard copies only, and will hence be stored in conventional folders in our offices. This applies wherever possible to contracts signed by customers and contractors as well as to all the documentation that refers to education and professional experience. Where this, for practical reasons, cannot be the case, e.g. when a customers’ or contractors’ name appears on an email or in other means of electronic submission, for instance in the form of an invoice, on an by customers and contractors signed lesson diary, we will print this email and the attached document, save it on a computer that is connected to the internet, and may keep the electronic submission in our “google” email account. The invoices and receipts to customers and business partner are computer generated, and that generating device must be, for the purpose of delivery, connected to the internet. The last mentioned documents usually contain the full-name and the address of a customer or a contractor.

We also store the clients and contractors telephone number in a mobile phone. Text message that are sent by us to a customer, contractor, and/or other business partner remain on our mobile phones, and the same applies to text messages that were received by us from customers or contractors. Received and outgoing calls will also remain stored in our mobile phones. By signing this agreement, you allow us, you allow us to use your data in the manner described above, and in the sense of the further description of the document at hand.      

      

(3) Why we need to collect personal information

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone and facsimile, by email, via our website www.teachertutors.com.au respectively tutorcafes.com, from your website, from media and publications, from other publicly available sources and from third parties, such as our subcontractors. We don’t guarantee for website links or the policies of authorised third parties, such as our subcontractors.

We collect your Personal Information for the primary purpose of providing our educational services to you, and providing information to our clients, including marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure, such as passing those information to a subcontracted educator. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

 

(4) How we will use and disclose personal information

Your Personal Information may be disclosed in a number of circumstances including the following:

Third parties where you consent to the use or disclosure (e.g. subcontracted teachers), and here required or authorised by law.

 

(5)How you can access your personal information, or ask for a correction

You may access the Personal Information we hold about you and you can update and/or correct it, which is subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

We will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

 

(6)Maintaining the Quality of your personal information

It is important to us to keep your Personal Information up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide high quality services to you.

 

(7)Sensitive information and third parties:

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only: For the primary purpose for which it was obtained, for a secondary purpose that is directly related to the primary purpose, with your consent or where required or authorised by law.

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties, such as our subcontracted educators, and/or by our customers (clients/parents/guardians). In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party, such as our subcontracted educators, and/or by our customers (clients/parents/guardians).

 

(8)Securing of Personal Information:

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files, which will be kept by us for a minimum of 7 years.
